Work Highlights
-
Contract Disputes
- Successfully obtained summary judgment in client’s favor in the defense of a breach-of-contract dispute. The client, a Canadian membership organization focused on the steel fabrication industry, was sued in connection with the cancellation of its annual convention at a local resort in 2020. The trial court agreed that the COVID-19 pandemic was an “Act of God” within the scope of the parties’ force majeure provision, and that the pandemic rendered performance of the contract impossible. Thus, the client’s performance was excused, and summary judgment in its favor was proper.
- Successfully negotiated a favorable settlement of claims in favor of client in a case relating to a former business relationship involving claims for breach of contract, misappropriation of trade secrets, unfair competition, trademark infringement, and other issues.
-
Appellate Practice
- Part of a team that successfully obtained summary judgment in favor of the client, a Kentucky state agency, in defense of a whistleblower claim. The plaintiff appealed to the Kentucky Court of Appeals, and Andy led the team that briefed the issues to the Kentucky Court of Appeals. The team obtained affirmance of the Franklin Circuit Court’s decision in the client’s favor, and the Kentucky Supreme Court later denied the plaintiff-appellant’s request for discretionary review.
- Part of a team that successfully obtained summary judgment in clients’ favor in defense of § 1983 claims brought by a former prisoner at the Franklin County Regional Jail in Frankfort, Kentucky. On appeal by the plaintiff-appellant to the Sixth Circuit Court of Appeals, Andy led the team that briefed the matter, and he argued to a three-judge panel in support of the clients’ position. The Sixth Circuit Court of Appeals affirmed the district court’s grant of summary judgment in the clients’ favor. See Franklin v. Franklin Cnty., et al., 115 F.4th 461 (6th Cir. 2024).
-
Construction Disputes
- Successfully negotiated favorable settlement for client construction company in connection with multi-million-dollar dispute over services provided in the construction of a hospital.
- Successfully filed and negotiated a favorable settlement of claims on behalf of homeowner against construction company in a case involving claims for breach of contract, negligent construction, violation of building codes, and more.
-
Non-Competition Disputes
- In a case involving a former employee of a medical device sales company, Andy was part of the team that successfully sought and obtained a temporary restraining order on behalf of the former employer prohibiting the former employee from further violating her non-compete agreement, as well as an agreed injunction extending those prohibitions. The team later reached a favorable settlement for the client company.
